Man caught with ‘underpants around his knees’ in Wirral car park sentenced

A MAN convicted of 'an act outraging public decency' in a Wirral car park has been given a 12-month community order.

Albitto Muriyankariyil, 30, of Coniston Road in Preston, appeared at Wirral Magistrates Court this morning (Tuesday, February 4) for sentencing after being found guilty, at an earlier trial, of an act that took place on March 23 last year.

Prosecutor Lionel Cope told that court that at around 11am that day, Phillip Carr was walking his children to their vehicle in the car park on Grange Road West in Birkenhead, when he saw Muriyankariyil in the car next to his.

According to a statement from Mr Carr read out in court, Muriyankariyil was on the back seat with a woman and both had their trousers and underwear down over their knees.

It came to light at the hearing, that Muriyankariyil had met the woman in Liverpool earlier that day and they were on their way to Wallasey.

The statement from Mr Carr – who went to confront the couple – read: "He was sat on the back seat with his underpants around his knees.

"There was an adult female in the car with her trousers down. She climbed onto the front seat and I told her the act was inappropriate. The woman got out of the car and started walking away with a prayer gesture to say she was sorry.

"The whole incident lasted about two minutes. I formed the opinion that the two must have been engaged in sexual activity.

"There were a lot of children about, it was broad daylight. It was inappropriate".

"He told me that he couldn't get his car started."

The court heard Muriyankariyil, a support worker with no previous convictions, has a wife and one-year-old child.

During the trial, he denied that any sexual activity had taken place or that he had exposed himself or that his trousers were down.

Passing sentence at Wirral Magistrates Court today, chair of the bench Anthony Canning imposed a 12-month community order, with 20 rehabilitation activities and 40 hours of unpaid work, along with a £114 victim surcharge and prosecution costs of £650.

Addressing Muriyankariyil, Mr Canning said: "The case was went to trial and you were found guilty of committing an act outraging public decency.

"A collection order has been attached to this amount. If you fail to pay, you could be brought back to court and face a custodial sentence. We will accept a minimum payment of £50 a month and the first payment must be made in 28 days.

"Do not break any part of the this community order, otherwise you will be in further trouble."
